1. Liability for the contents

WERKSDESIGN as the service provider in accordance with § 7 Abs.1 TMG shall be liable for own contents on those pages under the general laws. According to §§ 8 to 10 TMG we as the service provider shall be not obliged to supervise transmitted or collected third party-information or to investigate the circumstances that indicate an illegal activity. Under the general laws, the obligations to removal or barring of the use of information shall remain unaffected. The relevant liability shall be possible from the date of receiving knowledge of a given infringement. As soon we become aware of the given legal violations we shall remove those contents immediately.


2. Liability for links

Our offer shall include links to external websites on which WERKSDESIGN has no influence. Therefore we cannot accept any responsibility for those third parties- information. The provider or operator of websites shall be always liable for the contents of the linked sites. The linked sites shall be checked for any possible  legal violations till the time of linking. Illegal contents were not apparent till the time of linking. A permanent control of the linked sites shall be unreasonable without concrete indications of legal violations. As soon as we become aware of legal violations, we shall remove such contents immediately.


3. Other liability:

If information, software or documentation is made available free of charge, the liability for material and legal defects of information, software and documentation, especially for their correctness, accuracy, freedom from intellectual property rights of third parties, completeness and/or usefulness except in cases of intent or fraud or injury to life, body or health shall be excluded. The information may contain general descriptions of technical possibilities of certain products that might not be present in individual cases (e.g. due to the product changes). The required performance characteristics of products shall be agreed in individual cases during the purchase. The liability of the WERKSDESIGN for material and legal defects shall be subject to the above mentioned provisions and conditions. Additionally, any further liability of the WERKSDESIGN shall be excluded, unless mandatory liability is applicable due to  e.g. the premeditation, gross negligence, injury to life, body or health, due to taking over the guarantee of quality, fraudulent concealment of a defect or in case of a breach of fundamental contractual obligations. Compensation for damages in case of breach of fundamental contractual obligations shall be limited to contract-typical, foreseeable damages, to the extent that no intention or gross negligence is present. Although we strive to keep the websites of WERKSDESIGN free from viruses, the WERKSDESIGN cannot guarantee complete absence of viruses. Before downloading the information, software and documentation the user shall ensure appropriate security measures and virus scanners in order to protect himself/herself and to prevent the appearance of viruses on the WERKSDESIGN-websites. This shall not lead to a change in the burden of proof to the user's disadvantage.


4. Copyright

The content and works provided by the website operator on those sites shall be governed by the German copyright laws. Copying, editing, distribution and any kind of utilization beyond the limits of copyright shall require a written consent of WERKSDESIGN or respective author/originator. Downloads and copies of this website shall be permitted only for private, non-commercial use. If the contents on the website are not created by the operator, the copyright of third parties shall be respected. Especially third parties-contents shall be marked as such. Nevertheless, if you should become aware of a copyright violation, we request that you notify us accordingly. In case of discovering legal violations, we shall immediately remove such contents.


5. Validity

If sections or individual formulations of this text do not, do not fully or no longer correspond to applicable law, the content and validity of the remaining parts of the document shall remain unaffected.
